Maritime lawyers oppose 15% imported vehicle levy, demand court intervention

AS the controversy surrounding the introduction of 15 per cent National Automobile Council levy on imported vehicles lingers, some maritime lawyers have demanded court intervention as a way of resolving the matter.

The NCS had recently introduced a 15 per cent NAC levy on used imported vehicles, a decision which didn’t go down well with clearing agents in the country’s maritime sector.

The agents have argued that the NAC levy is mostly meant for new vehicles, questioning the rationale behind the introduction of the duty on used vehicles.

In a quick response, the service, in a statement by the National Public Relations Officer, Timi Bomodi, said the move was in compliance with the Economic Community of West Africa Common External Tariff.

But a Senior Advocate of Nigeria, Jean-Chiazor Anishere, said that the imposition of the 15 per cent levy on imported vehicles was wrong.

Anishere, who is also an ex-officer member of the Nigerian Maritime Law Association, said the levy’s imposition should be restrained by a court order.

“To me, the act of the Nigerian Customs Service is inimical to ‘having a second bite of an apple.’ It is wrong and irregular and such act should be restrained by a court order.”

On whether there are plans by the group to file a court case against the service, she said, “No plans because the NMLA needs to be approached formally.”

Also speaking, another maritime lawyer, Alban Igwe, said although the move was geared towards supporting local vehicle manufacturers, the government was not even giving enough support to local vehicle manufacturers.

He also said that Nigerians patronised more fairly used vehicles than new ones.

“The government would want to promote the local car manufacturing. I guess they have started by stopping the rival which is the newly manufactured vehicles, but I think it looks like Nigerians are acquiring more fairly used vehicles than the new ones. So, they knew that the competitor is not the newly manufactured vehicles, but now the fairly used vehicles, which is why they want to extend the jurisdiction to fairly used vehicles.

“Well, the implication is that if the government really wants to protect the local industry first, the government will have to support those local manufacturers so that they can manufacture at very good costs. It is the market forces that determine where you buy. If I can buy new vehicles in Nigeria from Innoson at N5m and I can buy a fairly used one at the same N5m, then I rather buy a new vehicle with a guaranty.”

He called for more support for local vehicle manufacturers from the government, adding that by so doing, the manufacturers of new vehicles would survive.

“The government will have to support the local manufacturing industry so that they will manufacture at good costs. It should be a business model and the manufacturers will now have the means to market their products very well so that people will know what they have. And, of course, the quality of the products should meet international standards because people are not just buying to drive, they also want products that will meet the international standards.”

Igwe said that by slamming the 15 per cent NAC levy, the government was simply forcing people to tilt towards patronising local manufacturers.

“The moment you call something a levy, it has an implication. A market model, which is the best, means that the government should promote their local manufacturing industry so that they can manufacture at very competitive rates, and there won’t be any need for the levy. When you begin to slam a levy, it means you have removed the issue of options. So they are forcing people to tilt towards patronising local manufacturers.

“The propensity to buy vehicles in Nigeria is increasing. Those who are importing are lamenting that the government is not subsidising their import, which means the cost of importation is very high. If it is like that, it is going to affect the end-users. It will affect even public transport, but that market must be open. The government has not supported the transport sector. Globally, when the transport is inefficient, it affects other sectors,” he concluded.

I don’t know whether there will be 2023 election yet – Pastor Adeboye

The General Overseer of the Redeemed Christian Church of God, Pastor Enoch Adeboye, says he doesn’t know whether there will be an election in 2023 yet.

The 80-year-old cleric said God has not told him whether there would an election next year.

He said God spoke to him about the 2019 elections more than a year to the election but the case has not been so with the 2023 election.

He quickly added that God might still speak to him about the 2023 general elections but He has not spoken to him yet.

The cleric said he is more concerned about Kaduna killings, oil theft, Nigeria’s depressing debt profile and other current national challenges.

Adeboye also said politics is not his calling and he will never be a politician.

He stressed that he does not support any presidential aspirant ahead of the 2023 general elections.

The octogenarian preacher said this on Sunday at the monthly Thanksgiving Service of the Church.

Adeboye said the clarification was important amid the criticisms against the church’s creation of a Politics Directorate and the instruction to members to be politically involved in the 2023 electioneering process.

Adeboye said, “Listen to me carefully and if you are going to quote me, quote me correctly. I am talking to those of you who are my children. Do you want to know the truth? And nothing but the truth? I am talking of myself now.

“As of now, as I am standing before you, I still don’t know whether or not there would be an election next year. Don’t say that Pastor Adeboye said there would be no election next year; that’s not what I said. Adeboye does not know yet, put the word ‘yet’.

“How come you don’t know? Because my father has not talked to me about it yet. The last time we had an election, He (God) spoke to me about the election by June of the previous year and this is April. So, it is not late but He hasn’t told me yet.”

The octogenarian thereafter threw a challenge to the congregation seated before him. Adeboye said, “He (God) must have told you – some of you who are prophets, you are closer to Him (God) but is there anyone of you here who can raise your hand to heaven and say without any doubt, there will be an election in 2023. If you can tell us, stand up and we will clap for a prophet.

“I don’t know yet. Remember to put the word ‘yet’,” he emphasised.

Court moves DCP Abba Kyari, 6 others to Kuje prison

The Federal High Court sitting in Abuja, on Monday, ordered the transfer of the embattled, suspended Deputy Commissioner of Police, DCP, Abba Kyari, and six others that are facing drug trafficking charges with him, to the Kuje Correctional Center

Trial Justice Emeka Nwike ordered the National Drug Law Enforcement Agency, NDLEA, to transfer the Defendants to prison custody, shortly after he denied them bail.

The court held that the NDLEA placed sufficient materials before it to warrant the refusal of bail to Kyari and his Co-Defendants.

The court equally denied bail to former members of the IRT, ACP Sunday Ubia, Inspector Simon Agirgba, and Inspector John Nuhu.

Other Defendants in the charge marked FHC/ABJ/57/2022, are; ASP Bawa James, as well as two drug traffickers that were arrested at the Akanu Ibiam International Airport in Enugu, Chibunna Patrick Umeibe and Emeka Alphonsus Ezenwane.

Meanwhile, Justice Nwite ordered accelerated trial of the Defendants, even as it fixed April 28 for the review of facts in respect of the case against Umeibe and Ezenwane.
It will be recalled that Umeibe and Ezenwanne, who were cited as the 6th and 7th Defendants in the charge, had on March 7, when they were arraigned alongside DCP Kyari, pleaded guilty to the drug trafficking charge against them.

The court had on Monday, listened to arguments from both the Prosecution and the Defence, on NDLEA’s application for the review of facts in respect of the two Defendants, to enable their conviction and sentencing.

Kyari’s lead counsel, Kanu Agabi, SAN, had contended that it would be prejudicial to his client for facts of the case to be reviewed and decision reached on it, while the trial is still subsisting.

He made reference to cases where Defendants, out of ignorance, pleaded guilty to a charge against them.

“It is not in the interest of justice for the facts to be reviewed while the trial is still ongoing”, he argued.

More so, Agabi, SAN, noted that both Umeibe and Ezenwanne were also mentioned in some counts in the charge that involved Kyari and the other accused police officers.

The NDLEA had in the charge before the court, accused DCP Kyari and the other four officers of conspiracy, obstruction and dealing in cocaine worth 17.55 kilograms.

It alleged that Kyari and his men unlawfully tampered with 21.25kg worth of cocaine that were seized from the two apprehended drug traffickers, Umeibe and Ezenwanne.

The police officers were said to have committed the offence between January 19 and 25, 2022, at the office of Inspector-General of Police (IGP) IRT, Abuja, in connivance with one ASP John Umoru (now at large), contrary to section 14(b) of the NDLEA Act, CAP N30 Laws of the Federation of Nigeria 2004.

Kyari was said to have attempted to bribe a senior officer of the NDLEA with $61, 400. 00 at a restaurant in Abuja to prevent the testing of part of the cocaine that was seized from the two arrested drug pushers.

On the other hand, the agency alleged that the duo of Umeibe and Ezenwanne, conspired with one IK that is currently at large, to import 21.35kg of cocaine into the country without lawful authority and knowingly possessed same, and thereby committed an offence contrary to and punishable under section 11(d) of the NDLEA Act, CAP N30 Laws of the Federation of Nigeria 2004.

Ogun Govt approves appointment of Prince Lawrence Jaiyeoba Adebajo as Orimolusi of Ijebu Igbo

The Executive Council of Ogun State has approved the appointment of Lawrence Jaiyeoba Adebajo as the new Orimolusi of Ijebu-Igbo effective 16th February, 2022. This news, has thrown Ijebu Igbo into a cheering town.

By this appointment, Oba Lawrence Jaiyeoba Adebajo has become a member of the Ijebu Traditional Council and a permanent member representing the Ijebu Traditional Council at the Ogun State Council of Obas.

In a statement signed by Mr. Adesoji Adewuyi, Director, Chieftaincy Affairs, on behalf of the Permanent Secretary, Ogun State Ministry of Local Government and Chieftaincy Affairs, the State Government, on behalf of the good people of the entire State, congratulates the new Orimolusi and wish him good health, long life and many years of peaceful and prosperous reign.

This development ends the over twenty-seven years legal battle for the throne of The Orimolusi of Ijebu-Igbo. From feelers, the town is already agog with celebrations awaiting the arrival of the Orimolusi of Ijebu-Igbo.

Otunba Femi Dinah, The Chairman, Orimolusi Coronation Committee expressed satisfaction on the progress made so far and promised to release an all-encompassing Coronation anniversary programme shortly. He has assured that the anniversary will be grand, considering the fact that the good people of Ijebu-Igbo had waiting so long for this positive development to happen.

Oba Lawrence Jaiyeoba Adebajo can be described as a man of destiny. He is proudly from the male Royal lineage of Ojuromi from Oke Tako in Ijebu Igbo. Sired by parents, Prince Tanimowo Adebajo and Mama Safuratu Adebajo (Nee Aderibigbe/JB.King) from Atikori, he was born on the 11th day of November, 1953 in Fowoseje, a remote village in Ijebu Igbo.

A good education, it is said, is the foundation for a better future. Young Prince Jayeoba with, a burning desire to get educated, started his elementary education at St. Bridget Catholic Primary School, Fowoseje and, at age twelve, completed his primary education with merits. He enrolled at St Vincent Catholic Secondary Modern School, Oke Sopen, Ijebu Igbo in 1966 and equally completed his Modern School education in 1968.

Fate however played a fast one on him as his Dad could no longer afford to pay his fees through to Secondary School. Painful as it was, Prince Jayeoba chose to make lemonade from the lemon life's circumstances threw at him. He was determined to, not only develop himself but, ensure he turned out to be a success in his life endeavours. He embarked on a lot of personal training and development exercises. He became dedicated towards achieving his goals and such dedication and relentlessness eventually paid off.

Through his late father's wise counsel, he started his career in Transportation business by joining a Transport Company located in Ibadan. As the saying goes, a star that is determined to shine cannot be hidden, not even by darkness. The budding youngster, Prince Jayeoba performed so well, breaking records in his assigned duty that a Luxury Bus Transport Company from Lagos, ICOC poached and brought him to Lagos in February 15, 1975. He resumed duty as a Transport Officer and soon learnt a lesson of life through his then Managing Director, Mr. InfeayinChucku Osondu who later became the Igwe of Umulolo, Okigwe, Imo State.

It was at the end of year party of the company in 1975, and his MD told his story of grass to grace. A steady growth from motor boy, to Danfo Driver to Transport officer and vehicle owner and eventually owned fleet of vehicles. This prepared him for the challenges ahead and equipped him with all that was needed to succeed in life as he ventured into Transportation business. With this insight from his boss, he started saving from monthly salary.

On December 24, 1977, Prince Jaiyeoba bought his first new car which unfortunately got burnt after the second day of purchase.

As one who would not allow setbacks to set him back. He quickly remembered the admonitions of his Boss and realized that even the accomplished suffers setbacks sometimes. The more bitter the lessons, the greater the successes will be. With zeal and determination for success Prince Jayeoba forged ahead.

In 1979, while still working for ICOC, he started making effort through personal contacts towards buying his first luxury Bus on hire purchase from a company owned then by Alhaji Saidu Gomina at Osogbo.

He eventually achieved his goal and bought a bus through a monthly payment that was spread for a period of 30 months. As a fair-minded man of conscience who would not want a clash of interest between his Boss and him, he resigned as a Workshop Manager and

started his own transport business which was later registered as L.A TANMO & Sons on August 1,1984; a business name he coined from his father's name "Tanimowo".

It is on record that he completed payment for the bus in a record time of 10 months. He was thereafter introduced to a company in Lagos and he got a luxury bus which he also completed its payment in 8 months.

The management of the company was so impressed at his performance and he was offered another Bus of which he also completed payment in 7 months. This was how his business grew and he became a proud owner of a fleet of buses.

The best, they say, will never rest. His company explored other frontiers and succeeded in securing a deal with Lagos State Waste Water Management Office (LSWMO) as an accredited Transport Company for the organization. With years of unblemished service to LSWMO, he was offered a Facility Management contract. Due to the company's prudent and transparent management process, he was given a commendation letter by the Agency last year, having performed meritoriously for over 12 years. His facility management contract with LSWMO is still valid till date.

No doubt, Prince Jayeoba is a successful and accomplished entrepreneur who before the age of 40, built his houses in Aledo Oke Agbo Ijebu Igbo and in Okota Lagos.

Prince Lawrence Jayeoba Adedeji Tanimowo Adebajo is a humble, noble, God-fearing and compassionate personality who is ready to help people rise above challenges. He has been able to assist many people through educational, business and financial support in various ways. He has helped people setup businesses and even stood as guarantors for those who needed huge financial assistance. To the glory of God, some of those he has assisted have become a success story today. His joy is seeing people celebrating successes around him.

A silent achiever, Prince Lawrence Jayeoba Adedeji Tanimowo Adebajo has to his credit a lot of anonymous donations. To him, he would want God to take Glory for enabling him to touch lives in various ways. His philanthropic activities earned him the title of Balogun Ijo of St. Peters Catholic Church, Oke Sopen, Ijebu Igbo where he serially donated toward the construction of the church and the purchase of Choir Robes.

He was responsible for the installation of Windows to a 2 Story Building in Holy Angel Catholic Church, Oke Agbo. He also donated generously towards the construction of Catholic Church in Ukpenu, near Ekpoma, Edo State without forgetting his community, Ijebu Igbo.

Apart from his various community support gestures, he also donated a complete set

of Musical Equipment to Christian Association of Nigeria, Ijebu North

Several community support at Oke Tako, Oke Sopen and Aledo, Oke Agbo where he has his house and even in Lagos where he resides.

Prince Jayeoba is not one that discriminates against religious leanings. This is evident in his contributions towards the renovation of several mosques in his neighbourhood. He recently received an award from a mosque in Okota, Lagos, his area of residence, for assisting in renovating the mosque.

In his local community, Prince Jaiyeoba was at various times the Secretary, Treasurer and the Chairman of his Community Development Association in Okota, Lagos. He was Chairman for several years before he voluntarily pulled out to allow others to contribute their quota towards the growth of the community.

Call him a reluctant candidate to the throne of Orimolusi of Ijebu Igbo, you will evidently find in him a man of impeccable character who keep to his words and maintain his integrity in all his dealings. However, fate has entrusted this exalted position on him and through faith he believes and states "if my ascension to the throne will uplift my dear town, Ijebu Igbo, so be it." Now, we have a man who is genuinely committed towards the growth of his town, Ijebu Igbo.

Prince Lawrence Jaiyeoba Adedeji Tanimowo Adebajo is married to Mrs. Bolanle Mary Adebajo, an Entrepreneur from Osan Ekiti, Moba Local Government of Ekiti State and they are blessed with children and grandchildren.

No resumption without meeting our demands, ASUU tells FG

The Academic Staff Union of Universities, Abuja zone says there will be no resumption in public universities until the renegotiated 2009 agreement is signed, implemented and the University Transparency and Accountability Solution deployed.

The ASUU zonal coordinator, Dr Salawu Lawal, made this known during a press conference at the University of Abuja in Gwagwalada on Monday.

According to him, members are ready to return to their duty posts as soon as their demands are met by the Federal Government.

He said, “You would recall that the Academic Staff Union of Universities declared a four-week rolling strike at the University of Lagos National Executive Council meeting held on February 14.

“Owing to the failure of the Federal Government to act within that period, the national action was rolled over for another eight weeks following the resolution taken at an emergency NEC meeting at the Festus Iyayi National Secretariat on March 14.

“The action, as you are probably aware is to, among other things, compel the Federal Government to sign and implement the draft renegotiated 2009 ASUU-FGN Agreement submitted to it by the Prof. Munzali Committee in May 2021.

“Deploy for use in the Nigerian university system, was the home-grown payment and personnel solution called UTAS developed by ASUU as replacement for the failed IPPIS.

“As usual, the Federal Government has ignored ASUU’s call for full implementation of that famous agreement and other memoranda signed with the union.

“No meeting has been held between the two parties since the commencement of the ongoing strike. The only exception is our union’s re-submission of UTAS for a retest.

“The summary is that unless and until the renegotiated 2009 agreement is signed and implemented and UTAS deployed, there will be no work in public universities.”

ASUU, Benin Zone, also on Monday pleaded with Nigerians to join the union in rescuing what it described as dying university system. The union’s Zonal Coordinator, Prof Fred Esumeh, in a press briefing at the ASUU Secretariat, University of Benin, Edo State, said the union called on well-meaning Nigerians to rise up and join it in repositioning the nation’s universities to a globally competitive level that would be able to produce the manpower required to jump-start the re-emergence of a country driven by technology.

He said, “We call on all well-meaning Nigerians, students, workers, civil society organisations to wake up and join ASUU to rescue the dying university system.

“It will help reposition the universities to be globally competitive and able to produce the manpower required to jump-start the re-emergence of the country.”

Also on Monday in Ibadan, ASUU flayed the Minister of State for Education, Emeka Nwajiuba, over what it described as a reckless comment that the union is “mean and wicked for shutting down universities.”

Primate Ayodele’s Prophecy Fulfilled As Nigerians Begin Heavy Protest Against Hardship

If only many of us had listened when the prophet warned, Nigeria would not be at this stage where citizens struggle to have a three-square meal per day.

Before the 2019 general elections, Primate Ayodele was one of the voices that told Nigerians that if they vote in Buhari for a second term, they will suffer for it. He made this statement before the election and categorically said Nigeria will collapse under president Buhari.

These were his words in 2018

“President Buhari’s declaration to contest for a second term in office is a waste of time. God is not with Buhari any longer to rule Nigeria. He should vacate the presidency. His followers may be telling him a lot of things, but Buhari’s second term in office will cause Nigeria another 40 years’ setback. I am not his enemy but I am talking as a prophet. They may take it or leave it. I have no apologies. Nigeria will collapse under him. They are deceiving him. In fact, the international community will fight against him. Buhari is just going to waste Nigeria’s resources if voted in again’’(https://tribuneonlineng.com/buharis-second-term-will-cause-nigeria-40-years-setback-primate-ayodele/)

Many tagged him as a prophet of doom when he made this prophecy most especially APC followers but as we speak, most of them have turned their back against President Buhari’s administration as the country has truly collapsed with the economy biting harder by the day.

Since president Buhari won the election, Primate Ayodele has been reminding Nigerians of what they will face every year whenever he releases his new year prophecy. In 2021, He revealed that kidnapping will be very rampant in the year and we all saw how it came to pass. Terrorists kidnapped government officials, military officers, religious leaders, traditional leaders, and several influential individuals.

In 2021 during a prophetic meeting, the man of God warned again that hardship will continue in Nigeria that citizens will begin to protest against it. He revealed that it will become a huge protest that will involve the young and old in the country.

These were his words

‘’Nigerians will protest because of the hike in food prices. There will be so much hardship which will cause the government the unexpected. The president must see into food matters otherwise Nigeria will go up in flames as a result of this’’ (https://dailypost.ng/2021/10/22/nationwide-protest-over-hike-in-food-prices-coming-primate-ayodele-warns-buhari/)

Fulfilling this, Some youths gathered under the aegis of the Angry Youth Movement, on Monday, brought traffic at the Berger end of the Lagos-Ibadan Expressway to a standstill over what they described as “untenable state of affairs” of the country.

The protesters said the roadblock was their response to the bad governance that plunged Nigerians into an “unprecedented level of hardship.

It was also revealed that the protest will be a nationwide action as the leaders vow to take it down to every zone in the country, it’s just a matter of time before everyone joins.

With these developments, Primate Ayodele’s prophecy has once again been fulfilled.

Sunday Igboho can't hold rally nor leave Cotonou despite release....Lawyer

Yoruba Nation agitator, Sunday Adeyemo, popularly known as Sunday Igboho, was reportedly released from detention on at least two conditions.

Lawyers in the know of his release conditions made this known shortly after the umbrella body of Yoruba Self-determination Groups, Ilana Omo Oodua Worldwide, announced Igboho’s release.

“The conditions are not too tough. He won’t hold any rally and can’t leave Cotonou,” one of the lawyers said.

Also, Counsel for the activist, Chief Yomi Aliyyu, SAN, said two of the condition were that Igboho should not leave the medical centre or Cotonou.

ASUU goes on one-month warning strike

After serious deliberations that dragged into the early hours of Monday, the National Executive Council, NEC, of the Academic Staff Union of Universities, ASUU, has voted to embark on one-month warning strike to press home its demands from the government.

It is believed, that the strike is to allow the Federal Government do the needful failure to which the union would go on an indefinite strike.

“We just want to give the government a long rope hoping that it would see the need to avoid a total paralysis of academic activities in the nation’s universities. We are parents too and have our children in the system but we cannot watch and allow the total collapse of education in the country.

“Our agitation is in the interest of all and if the system is made better, we will all enjoy it. Prominent personalities in the country have waded into the matter but the government seems recalcitrant. Our National President would explain more when he briefs the press later today,” he said.
